Our online store is hosted on Shopify Inc. (“Shopify”), which provides the ecommerce platform that enables us to offer and sell products online.

Sales contracts concluded through this Website are contracts between the customer and Telek Soma egyéni vállalkozó, trading as CozyPhoto4u.

Shopify provides technical platform services and is not the seller of the products offered through this Website.

3. Production and Fulfilment

Our physical products are made to order.

After an order has been accepted, the product may be manufactured, packaged, and shipped by Gelato or another fulfilment provider selected for the relevant order.

Gelato acts as an external production and logistics service provider. The use of Gelato does not affect CozyPhoto4u’s legal responsibilities as the seller.

The contractual relationship concerning the sale of products exists between the customer and Telek Soma egyéni vállalkozó, trading as CozyPhoto4u.

Customers should contact CozyPhoto4u regarding:

  • orders;
  • delivery issues;
  • withdrawal requests;
  • refunds;
  • defective or damaged products;
  • incorrect products;
  • complaints;
  • product-safety concerns.

4. Intellectual Property

All images, photographs, graphics, designs, product descriptions, text, logos, trademarks, videos, audio, software, and other content displayed on this Website are owned by CozyPhoto4u, its licensors, or other relevant rights holders.

Physical Print-on-Demand Products

Physical products, including canvas prints and framed artworks, are produced on a print-on-demand basis using fixed photographic designs.

Customers may choose only between predefined options, such as:

  • product type;
  • size;
  • frame colour;
  • other standard options displayed on the Website.

The customer does not provide the artwork or create an individual design.

The fact that a product is made to order does not, by itself, exclude the statutory right of withdrawal.

The 14-day right of withdrawal generally applies to these standard physical products and begins when the consumer, or a third party designated by the consumer other than the carrier, receives the goods.

Digital Products

Digital products may be supplied immediately after purchase.

Before supply begins, the customer must actively confirm that the customer:

  • expressly requests immediate supply of the digital content before the expiry of the withdrawal period; and
  • acknowledges that the right of withdrawal will be lost once supply of the digital content begins.

The relevant checkout checkbox must not be pre-selected.

The suggested confirmation wording is:

I expressly request that the digital content be supplied immediately, before the expiry of the 14-day withdrawal period, and I acknowledge that I will lose my right of withdrawal once supply of the digital content begins.

If the required consent and acknowledgement have not been properly obtained, the customer’s statutory withdrawal rights may remain applicable.

This section does not affect statutory rights concerning defective, incomplete, inaccessible, or non-conforming digital content.

Defective, Damaged, or Incorrect Products

If a product is defective, damaged, incomplete, incorrect, or otherwise does not conform to the contract, the customer may have statutory rights under applicable EU and national law.

Depending on the circumstances, statutory remedies may include:
