Terms of service

Effective date: 2026.10.07.

Overview

Welcome to CozyPhoto4u.

The terms “we,” “us,” “our,” “Seller,” and “CozyPhoto4u” refer to:

Seller: Telek Soma
Trading name: CozyPhoto4u
Address: Gerle utca 93, 6727 Szeged, Hungary
Email: cozyphoto2u@gmail.com
Website: https://www.cozyphoto4u.com

CozyPhoto4u operates this online store and website, including all related information, content, features, tools, products, and services, collectively referred to as the “Services.”

Our store is hosted on Shopify Inc. (“Shopify”), which provides the ecommerce platform that allows us to offer and sell our products and services.

These Terms of Service (“Terms”), together with the policies referred to in them, govern your access to and use of the Services:

Please read these Terms carefully. They contain important information about your rights and obligations.

By accessing or using the Services, you agree to these Terms and the policies referred to in them. If you do not agree, you must not access or use the Services.

Nothing in these Terms limits or excludes any mandatory rights available to consumers under applicable law.

Section 1 – Access and Account

You may use the Services only if you are legally capable of entering into a contract under the laws applicable to you.

If you are under the age of majority in your country of residence, you may use the Services only with the consent and supervision of a parent or legal guardian.

When creating an account or placing an order, you must provide accurate, current, and complete information, including billing, payment, and shipping details.

You are responsible for:

  • maintaining the confidentiality of your account credentials;
  • keeping your account information accurate and up to date;
  • all activities carried out through your account, except where unauthorized use is not attributable to you.

You must notify us without undue delay if you believe that your account credentials have been compromised.

Accounts may not be sold, transferred, or assigned without our prior written consent.

Section 2 – Our Products

We make reasonable efforts to display product descriptions, images, colours, dimensions, and other product information accurately.

Colours and product appearance may vary depending on the customer’s device, browser, monitor, and screen settings.

Physical products sold through the Website may include print-on-demand canvas prints and wooden-frame prints. These products are produced using fixed photographic designs and predefined options such as size and frame colour.

The fact that a product is manufactured after an order is placed does not, by itself, exclude the consumer’s statutory right of withdrawal.

Digital products may be supplied as digital content. The right of withdrawal for digital content may be lost once supply begins if the consumer has expressly requested immediate performance and acknowledged the loss of the right of withdrawal, as described in our Returns & Refund Policy.

All product descriptions, availability, and specifications may be updated from time to time. Changes will not affect orders already accepted by us.

We reserve the right to discontinue products or limit quantities where reasonably necessary, including for stock, production, technical, legal, or fraud-prevention reasons.

Section 3 – Orders

When you submit an order, you make an offer to purchase the selected products.

After submitting an order, you may receive an automatic acknowledgement confirming that we have received your order. This acknowledgement does not necessarily mean that the order has been accepted.

The sales contract is concluded when we send an order-confirmation email expressly accepting the order or otherwise confirm that the order has been accepted for fulfilment.

We may refuse or cancel an order before acceptance in justified circumstances, including:

  • suspected fraud or unlawful activity;
  • a clear pricing or technical error;
  • product unavailability;
  • inability to deliver to the selected destination;
  • payment failure;
  • an issue affecting the security or operation of the Website.

If we refuse or cancel an order after payment has been received, we will refund the amount paid using the original payment method, unless otherwise required or agreed.

Once an order has been accepted for fulfilment, cancellation may not always be possible because products may enter production promptly. This does not affect the consumer’s statutory right of withdrawal or rights relating to defective or non-conforming products.

Returns, refunds, withdrawal rights, and remedies for defective or non-conforming products are governed by our Returns & Refund Policy, without limiting any mandatory consumer rights available under applicable law.

You represent that purchases are for personal or household use and not for unlawful commercial resale.

Section 4 – Technical Steps of Contract Conclusion

The technical steps required to conclude a contract are generally as follows:

  1. Selecting the desired product and adding it to the shopping cart.
  2. Proceeding to checkout.
  3. Entering billing and shipping information.
  4. Selecting the preferred payment method.
  5. Reviewing the order summary.
  6. Correcting any input errors.
  7. Submitting the order by clicking the order-confirmation button.
  8. Receiving an order acknowledgement.
  9. Receiving an order-confirmation email accepting the order.

Before submitting the order, you may review and correct input errors using the editing tools provided on the checkout page.

After submission, you should contact us without undue delay if you identify an error. We will try to assist, but cancellation or correction may not be possible after the order has entered production or fulfilment.

Section 5 – Language and Storage of Contract

The contract is concluded in the English language unless the Website expressly provides another language version.

Order data and contract-related information are stored electronically by us and by relevant service providers.

We will provide order and contract information by email or through your customer account where available.

The concluded contract is not filed in a publicly accessible format. You should retain the order confirmation, invoice, and related communications for your records.

Section 6 – Prices and Billing

Prices are displayed on the Website in the applicable currency and include taxes where required by applicable law. Any additional delivery charges or other charges will be shown before the order is submitted.

Unless expressly stated otherwise, prices may not include:

  • delivery charges;
  • customs duties;
  • import taxes;
  • local handling fees;
  • other charges imposed by authorities or third parties outside our control.

The price applicable to an order is the price displayed at the time the order is submitted and confirmed in the order confirmation.

Price changes do not affect orders that have already been accepted.

If a clear pricing error affects an order, we may cancel the order before fulfilment. If we cancel an order after payment has been received, we will promptly refund the amount paid.

Promotions may be subject to additional terms. If a promotion-specific term conflicts with these Terms, the promotion-specific term applies to that promotion.

You agree to provide accurate and current payment and billing information.

Payment services are provided by external payment service providers. We generally do not store complete payment card details. Payment providers may apply their own terms and privacy policies.

Section 7 – Payment Methods

Available payment methods may include:

  • Visa;
  • Mastercard;
  • American Express;
  • Maestro;
  • UnionPay;
  • PayPal;
  • Apple Pay;
  • Google Pay;
  • Shop Pay;
  • BLIK;
  • MB WAY;
  • other payment methods displayed at checkout.

The availability of a payment method may vary depending on the customer’s country, currency, device, payment provider, and checkout settings.

The exact payment provider or providers used for a transaction may be identified at checkout and in the applicable payment provider’s terms and privacy policy.

Section 8 – Print-on-Demand Fulfilment

Gelato is our external print-on-demand production and fulfilment partner.

Gelato may:

  • manufacture ordered products;
  • package products;
  • arrange shipment;
  • provide production and shipment information;
  • assist with replacements or production-related issues.

The sales contract is concluded between the customer and Telek Soma / CozyPhoto4u.

Gelato does not replace our legal obligations as the seller. Customers should contact us regarding withdrawal requests, refunds, defective products, incorrect products, complaints, or other contractual matters.

Section 9 – Shipping and Delivery

We deliver products to the destinations shown at checkout.

Delivery times and delivery periods are estimates unless a specific delivery date or period has been expressly agreed.

We are responsible for delivery in accordance with applicable law.

If delivery is delayed, the consumer may have statutory rights, including the right to request delivery within an additional reasonable period and, where applicable, to terminate the contract and receive a refund.

For consumers located in the European Union, the risk of loss or damage passes to the consumer only when the goods are physically received by the consumer or by a third party designated by the consumer other than the carrier.

Further information about delivery methods, estimated delivery times, and shipping charges is available in our Shipping Policy.

Section 10 – Right of Withdrawal

EU consumers generally have the right to withdraw from distance contracts within 14 days without giving a reason.

The withdrawal period for physical products generally begins on the date on which the consumer or a third party designated by the consumer receives the goods.

The right of withdrawal applies to our standard physical products, including canvas prints and wooden-frame prints, unless a valid legal exception applies.

Our products are produced using fixed designs and predefined options. Choosing a standard size or frame colour does not, by itself, constitute personalisation or goods made according to the consumer’s specifications.

The right of withdrawal may not apply to goods genuinely made according to the consumer’s specifications or clearly personalised for the consumer.

For digital content not supplied on a tangible medium, the right of withdrawal may be lost once performance begins if the consumer:

  • expressly requests immediate performance;
  • provides active consent through the checkout process; and
  • acknowledges that the right of withdrawal will be lost once performance begins.

The detailed withdrawal and refund rules are set out in our Returns & Refund Policy.

Nothing in these Terms limits statutory rights concerning defective, damaged, incorrect, incomplete, or non-conforming goods or digital content.

Section 11 – Intellectual Property

The Services and their contents, including trademarks, brand names, text, product descriptions, images, graphics, product reviews, video, audio, software, page design, and the selection and arrangement of content, are owned by CozyPhoto4u, its licensors, or other rights holders and are protected by applicable intellectual property laws.

You may use the Services for personal and non-commercial purposes only.

You must not, without prior written permission:

  • reproduce or copy Website content;
  • distribute or commercially exploit Website content;
  • modify or create derivative works;
  • publicly display or perform Website content;
  • download or store substantial parts of the Website;
  • use Website content to create competing products or services;
  • remove copyright, trademark, or other proprietary notices.

CozyPhoto4u names, logos, product names, designs, and slogans may be trademarks of CozyPhoto4u or its licensors.

Shopify names, logos, products, and services are trademarks of Shopify.

All other trademarks belong to their respective owners.

Section 12 – Optional Third-Party Tools

The Services may provide access to tools or features supplied by third parties.

These tools may be subject to the third party’s separate terms and privacy policy.

We may not control or monitor every third-party tool, but this does not exclude any liability that cannot lawfully be excluded.

We may introduce new features and tools in the future. Unless otherwise stated, they will be subject to these Terms.

Section 13 – Third-Party Links

The Services may contain links to third-party websites or services.

Third-party websites are operated independently from us. We are not responsible for their content, availability, security, privacy practices, or terms.

If you access a third-party website, you do so at your own risk and should review its terms and privacy policy.

This section does not affect any mandatory rights you may have against us under applicable law.

Section 14 – Relationship with Shopify

The Website is operated using Shopify’s ecommerce platform.

Sales and purchases made through the Website are contracts between the customer and Telek Soma / CozyPhoto4u.

Shopify is not the seller of the products offered through the Website and does not replace our obligations to customers.

Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded.

Section 15 – Privacy

Personal data collected through the Services is processed in accordance with our Privacy Policy.

The Website uses cookies and similar technologies. Further information about the cookies used on the Website, their purposes, and how to manage your preferences is available in our Cookie Policy.

Shopify and other service providers may process personal data to provide hosting, ecommerce, payment, security, fulfilment, analytics, and other services.

Further information about personal data processing, Gelato, Shopify, payment providers, and international data transfers is provided in our Privacy Policy.

Section 16 – Customer Feedback

If you submit reviews, comments, suggestions, photographs, or other content (“Feedback”), you confirm that:

  • you have the right to submit the Feedback;
  • the Feedback does not infringe another person’s rights;
  • the Feedback is not unlawful, abusive, defamatory, misleading, or malicious;
  • the Feedback does not contain malware or harmful code.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, display, translate, and adapt the Feedback for operating, promoting, and improving the Services.

We may remove Feedback that violates these Terms or applicable law.

You remain responsible for the content of your Feedback.

Section 17 – Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery times, or product availability.

We may correct errors and update information.

If a clear error affects an order that has not yet been accepted, we may refuse or cancel the order.

If payment has already been received for a cancelled order, we will provide a refund.

This section does not allow us to change the agreed terms of an accepted order unlawfully.

Section 18 – Prohibited Uses

You may use the Services only for lawful purposes.

You must not:

  • violate applicable laws;
  • infringe intellectual property rights;
  • harass, abuse, threaten, or defame others;
  • provide false or misleading information;
  • impersonate another person or entity;
  • upload malware or harmful code;
  • send spam or phishing communications;
  • scrape or crawl the Website in an abusive or unauthorized manner;
  • collect personal data without authorization;
  • interfere with Website security or operation;
  • use the Services for unlawful resale or fraudulent activity.

We may suspend or terminate access where reasonably necessary because of a serious or repeated breach, unlawful activity, fraud, security risk, or misuse of the Services.

Where appropriate, we will provide notice and an opportunity to remedy the breach.

Section 19 – Termination

You may stop using the Services at any time.

We may suspend or terminate an account or access to the Services where reasonably necessary because of:

  • a serious or repeated breach of these Terms;
  • fraud or suspected unlawful activity;
  • a security risk;
  • misuse of the Services;
  • legal or regulatory requirements.

Termination does not affect rights or obligations that arose before termination.

The following provisions may continue after termination where relevant:

  • Intellectual Property;
  • Feedback;
  • Privacy;
  • Limitation of Liability;
  • Indemnification;
  • Governing Law;
  • any provision that by its nature should survive termination.

Termination does not affect any statutory consumer rights relating to an existing order.

Section 20 – Disclaimer of Warranties

We make reasonable efforts to keep the Services accurate, secure, and available.

However, temporary interruptions, maintenance, technical errors, or delays may occur.

To the extent permitted by applicable law, the Services may be provided on an “as available” basis.

Nothing in these Terms excludes, limits, or affects:

  • mandatory consumer rights;
  • statutory conformity requirements;
  • rights relating to defective or non-conforming products;
  • rights relating to defective digital content;
  • liability that cannot legally be excluded or limited;
  • rights arising from intentional misconduct or gross negligence where applicable.

Section 21 – Limitation of Liability

To the extent permitted by applicable law, we are not liable for indirect or consequential losses that are not reasonably foreseeable or are not a direct result of our breach.

This limitation does not apply to:

  • liability that cannot legally be excluded;
  • intentional misconduct;
  • gross negligence where exclusion is not permitted;
  • death or personal injury caused by our fault;
  • defective or non-conforming products;
  • defective or non-conforming digital content;
  • mandatory consumer rights;
  • any other liability that cannot lawfully be limited.

Section 22 – Indemnification

You are responsible for losses caused by your unlawful conduct or intentional breach of these Terms.

You agree to compensate us for third-party claims arising directly from:

  • your unlawful use of the Services;
  • your infringement of another person’s rights;
  • your intentional or seriously negligent breach of these Terms.

This provision does not require you to compensate us for losses caused by our own breach, unlawful conduct, or negligence.

It also does not limit mandatory consumer rights.

Section 23 – Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect.

The invalid provision will be interpreted or replaced to the extent necessary to comply with applicable law while preserving its intended purpose as far as legally possible.

Section 24 – Entire Agreement and Waiver

These Terms and the policies expressly referred to in them form the agreement governing use of the Services and purchases made through the Website.

The failure to enforce a provision does not constitute a waiver of that provision.

Any ambiguity will be interpreted in accordance with applicable law and mandatory consumer protection rules.

Section 25 – Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law allows otherwise.

We may transfer or assign our rights and obligations where reasonably necessary for business restructuring, sale of the business, or transfer of the Website, provided that this does not reduce your mandatory legal rights.

Section 26 – Governing Law

These Terms are governed by the laws of Hungary.

This does not deprive consumers of mandatory protections available under the law of the country in which they habitually reside.

Consumers may bring claims before a competent court in accordance with applicable EU and national law.

Section 27 – Alternative Dispute Resolution

Consumers may contact us first to attempt to resolve a dispute amicably.

Consumers may also initiate proceedings before the competent Hungarian conciliation board (Békéltető Testület).

Information about the Hungarian conciliation boards, their jurisdiction, contact details, and applicable procedures is available through the official website of the Hungarian conciliation board system:

Hungarian Conciliation Boards – Official Information

The competent conciliation board may depend on the consumer’s place of residence and the nature of the dispute.

Participation in conciliation proceedings will be handled in accordance with applicable Hungarian law.

Nothing in this section limits the consumer’s right to bring proceedings before a competent court or to exercise any other mandatory legal remedy.

Section 28 – Changes to These Terms

The current version of these Terms is available on this page.

We may update these Terms to reflect:

  • legal or regulatory changes;
  • changes to the Services;
  • changes to service providers;
  • technical developments;
  • operational changes.

Changes will not affect contracts already accepted unless required by law or expressly agreed with the customer.

Where required by law, we will provide notice of material changes.

The effective date at the beginning of these Terms will be updated when changes are made.
